Malta: Commissioner of Revenue (CfR) Notice - Intrastat Declarations
On 29 December 2021, the CfR issued a Notice to taxable persons reminding them of the obligation to file Intrastat Declarations. Taxable persons in default of their obligation have been asked to regularise the position by filing outstanding returns and reminded that penalties will be issued if they remain in default.
We know some taxpayers have received a notice directly, even if you have not it is the obligation still exists, even for business with one off activity and filing if required.
This applies to Yacht Owning Companies, incorporated in Malta who are registered for VAT. Taxpayers have been given a three-month timeframe to regularise the position.

What is the Intrastat Declaration
An Intrastat declaration is a legal obligation on all traders giving details of goods being traded within the EU, in this case between Malta and other EU member states. It is a legal obligation on all traders importing or exporting to an EU member state which exceeds the annual threshold of € 700 of Dispatches or Arrivals.
Filing Periods due dates and how to file
The declarations are a monthly filing requirement and are due by the 10th business day of the month following the reporting period. If the due date falls on a weekend or public holiday then the due date becomes the next business day.

What are the Penalties
Failure to comply may lead to criminal prosecution. A conviction will result in a fine of between € 700 and €3,500.
